California Prop 65, also known as the Safe Drinking Water and Toxic Enforcement Act of 1986, requires restaurants to warn patrons about the potential dangers of exposure to listed chemicals.

The CRA has a strong team of law firms with varying specialties to counsel our members on any matter.

Prop 65 + Food and Beverage – What Does it Mean?

Many foods and non-alcoholic beverages contain listed chemicals.  Therefore, all restaurants should post a Prop 65 notice to ensure compliance. Remember, the warnings must be “clear and reasonable” as defined in Prop 65.

All restaurants are required to post the “Safe Harbor” posting.

All restaurants that have a bar are required to post the “Safe Harbor” and “Distilled Spirits” posting.

Prop 65 + Other Toxic Exposures - What Does it Mean?

The “Safe Harbor” and “Distilled Spirits” postings cover restaurants for the most common categories of toxic exposure. However, the Prop 65 toxic chemical list was updated to include Bisphenol S (“BPS”). Restaurants should review their products and determine if ADDITIONAL WARNING postings are needed.

A print-on-demand general product warning posting for exposure to BPS. 

Restaurants that use products containing BPS should get specific guidance from legal counsel regarding warnings that may be required. This warning may need to be more specifically tailored to your business.
