What Is SB 68?

California Senate Bill 68 (SB 68) requires restaurant chains to disclose allergen information for every standard menu item on both physical and digital menus. The law aims to improve transparency and safety for consumers with food allergies.

CA is the first state to enact such requirements for restaurants, with a compliance deadline of July 1, 2026.

Who does SB 68 affect?

SB 68 applies to:

  1. Any food facility with 20 or more locations worldwide
  2. Operating under the same name and substantially the same menu
  3. With at least one location in California

What does SB 68 require?

Covered restaurants must disclose the presence of the Top 9 Major Allergens for every standard menu item:

  • Milk
  • Eggs
  • Fish
  • Shellfish
  • Tree Nuts
  • Peanuts
  • Wheat
  • Soy Sesame

What does SB 68 disclosures look like?

Under SB 68, covered restaurants must disclose food allergens to customers as follows:

Menu Disclosure Options

Provide food allergen disclosure either directly on the menu (next to or immediately below each item) or in a digital format, such as a QR code that links to an online menu.

Alternative Written Format Required

If a digital method is used for menus/disclosure, restaurants would be required to offer an alternative written format for customers who cannot access digital information. Acceptable alternatives may include a separate allergen-specific menu, an allergen chart, a grid, a booklet, or other written materials.

Communication Methods

Communicate allergen information using either the common or usual names of the allergens or standardized pictograms.
