Court Backs California Restaurants in Suit Against Berkeley’s Ban on New Natural Gas Hookups
The Ninth Circuit Court has determined that the City of Berkeley’s ban on natural gas pipelines in buildings violates federal law. The CRA filed a lawsuit against Berkeley in November of 2019 after the city approved the ban.
“Natural gas appliances are crucial for restaurants to operate effectively and efficiently, as they allow for a wide variety of cuisines and innovations in the restaurant industry,” said CRA President and CEO, Jot Condie. “Cities and states cannot ignore federal law in an effort to constrain consumer choice, and it is encouraging that the Ninth Circuit upheld this standard.”
