SB 878 by Senator Connie Leyva (D- Chino) would require all restaurant, grocery and general retail employers to provide employees with at least a 21-day schedule and provide it seven days in advance.
This bill essentially requires employers to predict and impose an inflexible 28-day work schedule. The employer would be penalized and required to provide the employee with punitive pay per shift for each previously scheduled shift that the employer alters, moves to another date or time or cancels, and each previously unscheduled shift the employee is required to work. Additionally, if the employer fails to properly provide the punitive pay, the employer is subject to significant penalties and costly litigation.
