Update: Oakland mobile food truck ordinance

On Dec. 6, the Oakland City Council voted on temporary regulations for mobile food truck gathering sites. The ordinance will allow mobile food trucks to operate in groups, similar to farmers markets, in various areas of council districts 1, 2, 3 and 4.

The CRA worked closely with the sponsors of the legislation, councilwomen Jane Brunner and Rebecca Kaplan, as well as the Community & Economic Development staff during the process. The CRA negotiated the following key amendments to the legislation:

  1. Quickservice restaurants will be included in the 100-feet separation requirement between brick-and-mortar restaurants and mobile food truck group sites.
  2. Businesses in business improvement districts can choose to allow or not allow mobile food trucks to operate within their boundaries.
  3. There will be a four-hour time limit for mobile food group operations per site, per day.

The ordinance will become effective Jan. 6 and will sunset Jan. 1, 2013 as the city expects to have permanent regulations for all mobile food truck and pushcart operations by that time. CRA will continue working with the city as it crafts the permanent ordinance and will send updates and information on stakeholder meetings and opportunities for businesses to give input.
