Update: DLSE issues FAQs regarding mandatory notices required in 2012

The Division of Labor Standards Enforcement issued a new set of frequently asked questions and answers this week, as it works to address concerns with the Wage Theft Prevention Act of 2011, which took effect Jan. 1.

The new law requires that all employers provide each employee with a written notice at the time of hire that contains specified information and must be provided in the language the employer normally uses to communicate employment-related information to the employee. The section requires that the labor commissioner make available a template that complies with the requirements of the notice.

The CRA has been working with the DLSE to have them alter their issued template for employer use, as there are a number of concerns about the wage information section not including explicit accommodation for “at will” employment relationships.
