Defeated: Paycheck Cashing Fee Liability Legislation

SB 1188 (Florez - D-Shafter) would have exposed employers to increased liability if their employees were charged a bank fee related to cashing a paycheck. This bill created a new crime for employers and, under this bill, an employer whose employees were charged a paycheck cashing fee at no fault of the employer would nonetheless have been guilty of a misdemeanor, subject to fines and exposed to liability for “sue your boss”- type lawsuits.
